An employee at the Shady Lane Home who was fired for absenteeism in 2013 has regained her job, thanks to CWA. Local 1085 President Rich Dann said the union reached a settlement with the Gloucester County Improvement Authority just before the start of an arbitration hearing on September 17.
The employee, who worked as a nurse's aide, had received a number of disciplinary actions for excessive absenteeism, even though she produced medical documentation. She was finally terminated in June of 2013, at which time Local 1085 filed a grievance. The union maintained that management did not follow progressive discipline correctly and also that some of the employee's absences were protected by the Family & Medical Leave Act. However, before the arbitration hearing began, management agreed to settle the case by reinstating the employee.
Dann said the union is currently waiting for decisions in two other arbitration cases involving Shady Lane.
